By accessing or using the website, application, and other online or offline services provided by us, or as a visitor to one of our customers’ physical locations such as parking lots where our technology is used (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Service.

Description of Service

The Service is provided by Movilio LLC and allows users to make payments for parking fees via a mobile application. Users can find and pay for parking at participating locations, view parking availability, and access related features.

Registration and Account

1. You may be required to create an account to use the Service. You agree to provide accurate and complete information and to keep it up to date.
2. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.
3. You may only use the Services if you are at least 16 years old. Parents or guardians are responsible for the acts of their children when using the Services.

Payment and Fees

1. You agree to pay all applicable parking fees and charges as displayed within the App. Fees are subject to change.
2. Payments may be processed by third-party payment processors, and you agree to their terms and conditions.
3. We may authorize charges in advance using your payment information.
4. You are responsible for keeping your payment information current.
5. All payments, including subscriptions, are final and non-refundable unless explicitly stated otherwise.
6. Subscription fees are billed in advance and recur automatically unless cancelled prior to the current billing period.

SMS Communications

1. By using the Service, you agree to receive SMS messages or calls related to your account and use of the Service.
2. Standard carrier messaging and data rates may apply.
3. We are not responsible for delayed or undelivered messages.
4. You may opt out by texting “STOP,” though doing so may impact Service functionality.

User Conduct

1. You agree not to use the Service for unlawful or unauthorized purposes.
2. You will not interfere with or disrupt the Service or related systems.
3. You will not engage in conduct that harms the Service or other users.

Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Termination

1. We may suspend or terminate access to the Service at any time, with or without cause.
2. Upon termination, your right to use the Service immediately ceases.
3. We are not liable for any discontinuance of the Service.

Disclaimer of Warranties

1. The Service is provided “as is” and “as available” without warranties of any kind.
2. Use of parking locations and Services is at your own risk.
3. We are not responsible for parking fines, towing, theft, or personal injury.

Limitation of Liability

To the fullest extent permitted by law, Movilio LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee.
